Wakatipu House Tour - Event Terms & Conditions

Tickets Sales and Participation

1.     Friends of Shotover (“FOS”) organises and hosts the Wakatipu House Tour (“the Tour”) as a fundraiser for Shotover Primary School (SPS).  By registering to participate in the Tour you (“the Participant”) acknowledge and agree that these terms and conditions (“Terms”) apply to your registration and participation in the Tour.

2.      As you will be visiting people’s homes as part of the Tour you will need to be respectful and adhere to all instructions from event staff and volunteers. FOS reserves the right to remove any Participants who do not adhere to instructions from volunteers or FOS members. It may be a condition of entry to some of the homes that make up the Tour that a search of a person and/or their possessions will be required at the time of the entry and/or exit.

3. The Participant will be liable for any damage they cause to any property, either directly or indirectly / by negligence. The includes any insurance excesses that may be payable.

4.    FOS / SPS or any associated property owner, will not be liable for any injury you sustain during the Tour, or for any loss or damage (including consequential loss or damage, loss of profits, loss of revenue, or loss of savings) which may be suffered or incurred or which may arise directly or indirectly in respect of your participation in the Tour.

5. You will indemnify FOS / SPS and the associated property owner, against any losses and damages and will, at your cost, defend or settle any claim, lawsuit, action or proceeding brought against FOS / SPS arising from (a) any breach of these Terms by you; and (b) your participation in the Tours.

6. Except as set out in clause 7 below, any refund of the ticket price is at the sole discretion of FOS. No refund or exchange on tickets will be given, except as required by law, within 10 days of the Tour. Credit card fees and service fees are non-refundable.

7. Should COVID-19 restrictions affect the Tour we will contact you. The Tour will run in Queenstown at Alert Level 1. Should Alert Levels rise nationally or in Queenstown, the Tour will be either postponed or canceled. In either situation, Participants will be offered a full refund, excluding booking, ticketing, and credit card fees.

8.      You consent to FOS carrying out filming, sound recording, and/or photography of the Tour as a participant and you consent to the use by FOS of any such recording or photography for promotional, marketing, and other purposes.

9.      All information provided by you to FOS will only be used to contact you if necessary and if we repeat the tour, for your information. You may at any time contact spsfos@gmail.com to update these details (including being removed from any list except for COVID-19 tracing requirements).

11.    Whilst all material and content provided with regard to the Tour is derived from sources believed to be accurate and current, we give no representation or warranty as to the reliability, accuracy or completeness of the content sourced from third parties.

12.    All implied conditions and warranties in relation to these terms are excluded to the fullest extent permitted by law. You agree that to the extent that you are acquiring goods or services under these Terms for the purposes of a business, the guarantees provided under the Consumer Guarantees Act 1993 shall not apply to FOS’s supply of such goods and services.

14.    Children under the age 14 years of age are not permitted to attend the Tour.

15.    You understand that your information will be held by FOS for the purposes of COVID-19 contact tracing and may be disclosed to the Ministry of Health should the need arise.
